Rubbish Removal Barnes Service Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Removal Barnes provides rubbish removal and waste collection services to domestic and commercial customers within our service areas. By booking a collection, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means any individual, company or organisation that requests or receives our rubbish removal or waste collection services.

Services means the rubbish removal, waste collection, clearance, loading, transportation and related services provided by us as agreed at the time of booking.

Waste means any items, materials or substances presented by the Customer for collection and disposal in accordance with applicable waste regulations.

We, us, our means the operator of Rubbish Removal Barnes providing the Services.

2. Scope of Services

We provide rubbish removal and waste collection services for household and commercial waste within our designated service areas. Our Services typically include collection of bagged waste, bulky items, garden waste, light construction debris, and general refuse, subject to applicable waste regulations.

Certain items are restricted or prohibited, including but not limited to hazardous waste, clinical waste, chemicals, asbestos, gas bottles, pressurised containers, and any item that we reasonably deem unsafe to handle or transport. We reserve the right to decline any collection that in our opinion may breach health and safety rules or waste legislation.

3. Booking Process

3.1 Bookings can be made by telephone or through our online booking channels, where available. When placing a booking, the Customer must provide accurate details of the waste to be collected, the collection address, contact information and any access or parking restrictions.

3.2 All bookings are subject to our availability. Any time or date provided for the collection is an estimate only. We will make reasonable efforts to attend within the agreed time window but cannot guarantee exact arrival times due to traffic, weather, or operational issues.

3.3 The Customer is responsible for ensuring that a person over 18 years of age is present at the property at the time of collection, unless prior written arrangements have been agreed. If access cannot be gained or no one is present, we may treat the visit as a failed collection and reserve the right to apply a call-out or cancellation charge.

3.4 The Customer must inform us at the time of booking if there are any special requirements such as limited access, stairs, restricted parking, or the need for additional labour. Failure to disclose relevant information may result in additional charges or our inability to complete the work as scheduled.

4. Estimates, Quotes and Pricing

4.1 We may provide estimates based on the description of the waste and photographs supplied by the Customer. These estimates are not binding and are subject to the actual volume, weight and nature of the waste assessed at the time of collection.

4.2 A final price or updated quotation will be confirmed on site once our team has inspected the waste. If the Customer does not agree to the revised price, we reserve the right to cancel the Service or adjust the scope of work, in which case a reasonable attendance or assessment fee may apply.

4.3 Our pricing may be based on the volume of waste, weight, type of materials, labour involved, and any additional services such as dismantling, packing or extended loading times. Parking costs, congestion charges and any fees arising from access restrictions may also be added to the final invoice where applicable.

5. Payments and Charges

5.1 Unless otherwise agreed in writing, payment is due in full on completion of the collection. We accept common methods of payment such as cash, debit card, credit card or bank transfer as advised at the time of booking.

5.2 For business Customers, we may at our discretion agree to invoice on account terms. Where account terms are granted, payment is due within the period stated on the invoice. If no period is specified, payment will be due within 14 days of the invoice date.

5.3 If payment is not received by the due date, we reserve the right to charge interest on the overdue amount at the statutory rate applicable in England, as well as reasonable costs incurred in recovering the debt, including legal fees.

5.4 All prices are quoted exclusive of any applicable taxes unless stated otherwise. Where value added tax or other applicable tax is chargeable, it will be added to the invoice at the prevailing rate.

6. Customer Obligations

6.1 The Customer must ensure that all waste is safely accessible for our team and that the collection area is free from hazards such as sharp objects, unstable structures, aggressive animals, or dangerous substances.

6.2 The Customer warrants that they either own the waste to be removed or have the full authority of the owner to arrange its removal and disposal. The Customer will indemnify us against any claim by a third party alleging wrongful removal of items.

6.3 The Customer must not conceal hazardous or prohibited materials within bags or containers presented as general waste. If such materials are discovered, we may refuse to continue with the Service, apply additional charges for safe handling, or require the Customer to arrange alternative disposal in accordance with law.

6.4 Where our team is required to enter a property or building, the Customer must ensure that the premises are safe and that suitable access routes are clear. The Customer is responsible for securing valuables and fragile items in the vicinity of the work area.

7. Cancellations, Amendments and Failed Collections

7.1 The Customer may cancel or amend a booking by contacting us directly. We ask for at least 24 hours notice prior to the scheduled collection time. Where sufficient notice is provided, no cancellation fee will be applied.

7.2 If the Customer cancels or attempts to reschedule with less than 24 hours notice, we reserve the right to charge a reasonable late cancellation fee to cover administration and allocated resources.

7.3 In the event that our team attends the agreed address and is unable to carry out the collection due to reasons within the Customer's control, including lack of access, parking issues not disclosed in advance, or no one present to grant entry, we may treat this as a failed collection and apply a call-out or cancellation charge.

7.4 We may cancel or reschedule the Service for reasons beyond our reasonable control, including adverse weather, vehicle breakdown, staff illness, or legal restrictions. In such cases, we will notify the Customer as soon as practicable and offer an alternative appointment. We will not be liable for any indirect losses arising from such changes.

8. Waste Handling and Regulations

8.1 We operate in accordance with applicable UK waste management legislation and regulations. We will transport and dispose of collected waste only at authorised facilities such as licensed transfer stations, recycling centres or disposal sites.

8.2 Once waste has been loaded onto our vehicle and payment has been made or agreed, title to the waste will generally pass to us, and we will assume responsibility for its handling and disposal. This is without prejudice to our rights under these terms if the waste is later found to be hazardous or misdescribed.

8.3 We support responsible waste management and may at our discretion prioritise reuse and recycling where practical. However, we provide no guarantee that any particular item will be reused or recycled unless this has been expressly agreed in writing.

8.4 Where required by law, we will maintain appropriate documentation and records relating to waste collections and transfers. Business Customers may request copies of relevant documentation such as waste transfer notes, which will be provided where applicable.

9. Health, Safety and Access

9.1 Our teams are instructed to work in a safe manner and may refuse to carry out any task they consider unsafe or beyond reasonable manual handling limits. This includes carrying extremely heavy items up or down stairs, working at height without suitable equipment, or entering areas that appear structurally unsound.

9.2 The Customer agrees to provide suitable information regarding access, parking and any risks at the premises. If special equipment, permits or arrangements are needed to complete the work safely and legally, the Customer must notify us in advance so that additional charges and arrangements can be agreed.

9.3 We are not responsible for delays or inability to complete the Service due to parking restrictions, road closures or access limitations that were not disclosed at the time of booking.

10. Limitation of Liability

10.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded under English law.

10.2 Subject to the paragraph above, we will not be liable for any indirect, consequential, or purely economic loss, including loss of profit, loss of business, loss of opportunity, or loss of data, arising out of or in connection with the provision of the Services.

10.3 Our total aggregate liability to the Customer in respect of all losses arising under or in connection with any contract for Services, whether in contract, tort including negligence, breach of statutory duty or otherwise, shall not exceed the total amount paid or payable by the Customer for the specific Service giving rise to the claim.

10.4 While our teams will take reasonable care when operating on the Customer's premises, we cannot accept responsibility for pre-existing damage, inherent defects, or normal wear and tear. The Customer must report any alleged damage caused by our team within 48 hours of the Service, providing reasonable evidence.

11. Complaints and Dispute Resolution

11.1 If the Customer is dissatisfied with any aspect of our rubbish removal or waste collection service, they should contact us as soon as possible with full details of the issue. We will investigate the matter and aim to provide a response within a reasonable period.

11.2 Where appropriate, we may offer to rectify the issue by revisiting the site, adjusting charges, or providing another practical remedy. Any such remedy will be offered at our discretion and in full and final settlement of the matter, unless otherwise required by law.

12. Data Protection and Privacy

12.1 We will collect and process personal data about Customers only to the extent necessary to provide our Services, manage bookings, process payments, and meet our legal obligations.

12.2 Customer information will be stored securely and will not be sold to third parties. We may share limited data with our service partners or external providers where this is necessary to provide the Services, process payments, or comply with legal requirements.

13. Termination and Suspension

13.1 We may suspend or terminate the provision of Services to a Customer with immediate effect if the Customer fails to pay any amount due, breaches any material term of these conditions, behaves abusively towards our staff, or requests that we act in a way that would breach applicable laws or regulations.

13.2 Termination of Services does not affect any rights or obligations that have already accrued, including the obligation to pay for Services already supplied.

14. Changes to These Terms

14.1 We may update or amend these Terms and Conditions from time to time to reflect changes in law, our business operations, or industry practice. The updated terms will apply to new bookings from the date they are published or otherwise communicated to Customers.

14.2 The version of the Terms and Conditions in force at the time of the Customer's booking will normally apply to that specific Service, unless a change is required by law or the parties agree otherwise in writing.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.

15.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, including any non-contractual disputes or claims.

By confirming a booking or allowing our team to commence work, the Customer acknowledges that they have read, understood and agree to be bound by these Terms and Conditions for rubbish removal and waste collection services.
